1. Acceptance of Terms

By accessing or using PisciViva ("Platform", "we", "us"), you agree to these Terms of Service. PisciViva is operated by PisciViva Lda., registered in Portugal. If you do not agree, please do not use the Platform.

2. Platform Services

PisciViva provides: (a) AI-powered pool diagnostic and calculator tools; (b) a marketplace for renting private swimming pools; (c) an e-commerce shop for pool products; (d) a directory of pool professionals; (e) a community forum; and (f) pool build cost estimation tools.

3. User Accounts

You must be 18 or older to create an account. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate and complete information. PisciViva reserves the right to terminate accounts that violate these Terms.

4. Pool Rental Marketplace

PisciViva acts as an intermediary platform. We do not own, manage, or operate any pools listed on the Platform.
Pool Hosts are solely responsible for the safety, legality, and accuracy of their listings.
Guests are responsible for complying with the Host's pool rules during bookings.
All payments are processed through Stripe. PisciViva charges a 12.5% service fee to guests and a 5% commission to hosts per completed booking.
Cancellation policies are as stated on each individual listing.

5. Professional Directory

PisciViva does not endorse or guarantee the work quality of any professional listed on the Platform. All professional relationships are directly between users and professionals. PisciViva does not participate in the execution or payment of professional services.

6. AI Tools Disclaimer

AI-generated diagnoses and recommendations are for informational guidance only. They do not constitute professional advice. Always verify AI suggestions with appropriate testing equipment and, where necessary, consult a certified pool professional. PisciViva accepts no liability for outcomes resulting from reliance on AI advice.

7. Prohibited Uses

Listing pools you do not own or have authority to list
Making false or misleading representations
Using the Platform for any unlawful purpose
Harassing or threatening other users
Circumventing the platform payment system

8. Governing Law

These Terms are governed by the laws of Portugal. Any disputes shall be subject to the exclusive jurisdiction of the Portuguese courts. If you are an EU consumer, you may also have rights under EU consumer protection law.

2. Data We Collect

Account data: Name, email, password (hashed), profile photo, role
Identity data (hosts/pros): NIF, bank account details (held by Stripe, not PisciViva)
Booking data: Booking history, payment confirmation, dates and times
AI conversation data: Pool problem descriptions and AI responses (anonymised after 90 days)
Usage data: Pages visited, features used, device type (analytics purposes)

3. Legal Basis (GDPR)

We process data on the basis of: contract performance (bookings), legitimate interests (platform improvement), legal obligation (financial records), and consent (marketing communications).

4. Your Rights

Under GDPR, you have the right to: access your data, correct inaccurate data, request deletion ("right to be forgotten"), object to processing, and data portability. Submit requests to: janak129bhandari@gmail.com

5. Data Retention

Account data is retained while your account is active. Booking records are retained for 7 years for legal/financial compliance. AI conversation data is anonymised after 90 days.

Cookies We Use

PisciViva uses minimal cookies to function correctly:

Essential: Session authentication (Supabase), language preference, cart contents. Cannot be disabled.
Analytics: Anonymous usage statistics. Can be disabled in browser settings.

We do not use advertising cookies or share cookie data with advertising networks.

Host Agreement

By listing a pool on PisciViva you confirm:

You are the legal owner of the property or have explicit authorisation from the owner to list it
Your pool complies with all applicable Portuguese/local safety and hygiene regulations
Your homeowner's insurance is valid and covers third-party use of the pool
All information in your listing is accurate and up to date
You will maintain your pool in a clean, safe condition for every booking
You accept PisciViva's standard cancellation policy unless you have agreed a custom policy

Host Fees & Payouts

PisciViva deducts a 5% commission from each completed booking. Payouts are processed via Stripe to your registered Portuguese IBAN within 2–5 business days of booking completion. PisciViva reserves the right to withhold payouts pending resolution of any guest dispute.
